Nancy authored her fourth Supreme Court amicus brief for AIPLA. The brief was filed in Unicolors v H&M, which is scheduled to be heard on November 8, 2021. The ruling will be important to copyright owners because it will clarify the effect of making a mistake in copyright registration under Section 411(B) of the Copyright Act. If the Supreme Court affirms, a copyright owner who made an innocent mistake in registration but was aware of the underlying facts may suffer severe penalties, such as invalidation of the registration and potential loss of statutory damages and attorney’s fees.
